Con la reciente decisión de PCC Structurals, Inc., 365 NLRB No. 160 (Dec. 15, 2017), la Junta Nacional de Relaciones del Trabajo (Junta) revocó la doctrina establecida en Specialty Healthcare & Rehabilitation Center of Mobile, 357 NLRB 934 (2011) (Specialty) y re-estableció el estándar tradicional de comunidad de intereses para determinar si una unidad de negociación es apropiada para propósitos de negociación colectiva. Una unidad de negociación es un grupo de dos o más empleados que comparten una “comunidad de interés” y pueden ser juntados razonablemente con el fin de negociaciones colectivas. Las unidades típicamente se describen por el tipo de trabajo o clasificación de los trabajadores. No todos los grupos de empleados pueden unirse en una ‘unidad’ para negociar colectivamente. Esa es una determinación que hace la Junta para asegurar que la unidad a negociar sea razonable y efectiva
